3. Quotations, Proposals & Bookings
Any estimate, proposal, or quotation issued by CrowdCulture Events via email (Nirajagarwal5788@gmail.com), WhatsApp (+91 9833984214), or formal proposal document remains valid for 14 calendar days from the date of issue unless specified otherwise.
Dates and production slots are secured only upon receipt of the signed Scope of Work / Event Contract and the requisite non-refundable booking deposit.
4. Payment Milestones & Taxes
Standard commercial payment milestones for event production are structured as follows:
- Booking Deposit (50%): Due immediately upon contract signing to lock event dates, initiate CAD renders, and secure venue/artist holds.
- Midway Production Tranche (40%): Due 7 to 14 days prior to the event date to secure technical hardware, logistics, fabrication, and artist travel.
- Final Settlement (10%): Due immediately prior to show call or on event D-Day prior to gate opening.
All applicable Goods and Services Tax (GST) and statutory levies will be charged in accordance with prevailing Indian tax laws. Delayed payments may result in suspension of technical setup or delay in artist arrivals without liability to CrowdCulture Events.
5. Cancellation, Postponement & Refund Policy
Due to substantial advance commitments made with venue authorities, technical vendors, fabricators, and celebrity artists:
- Cancellation > 30 Days Prior: The 50% booking deposit is retained to cover pre-production and design costs incurred. Any uncommitted third-party vendor advances will be refunded.
- Cancellation within 15–30 Days: 75% of the total project value is payable.
- Cancellation within 14 Days: 100% of the total contract value is non-refundable and due in full.
- Event Postponement: Postponement requests must be submitted in writing at least 21 days in advance. Rescheduling is subject to artist/gear availability, and any additional vendor re-booking surcharges will be billed to the client.
6. Statutory Licenses & Municipal Clearances
CrowdCulture Events can assist or coordinate in obtaining necessary municipal, police, and copyright clearances across Mumbai and Maharashtra (such as BMC permits, Fire NOC, Mumbai Police Commissionerate permissions, Electrical Inspector clearances, and PPL / IPRS / Novex music licenses).
The client is solely responsible for timely provision of required documentation, venue ownership NOCs, and payment of statutory government fees unless turnkey licensing is explicitly included in the signed budget.
7. Artist, Performer & Talent Riders
Artist bookings are subject to the specific hospitality, technical, and travel riders provided by the artist's management. CrowdCulture Events acts in good faith to fulfill all riders. In the rare event of an artist being unable to perform due to medical emergencies, travel disruption, or unforeseen personal crises, CrowdCulture Events will make best efforts to secure an equivalent replacement artist; however, CrowdCulture Events shall not be held liable for compensatory damages beyond the refund of unspent artist fees.
8. Safety, Security & Venue Rules
CrowdCulture Events enforces rigorous safety protocols for stage trussing, electrical cabling, and crowd barriers. Clients and their guests are required to adhere to venue guidelines, capacity limits, fire exits, and local noise curfews (such as 10:00 PM sound restrictions under Mumbai noise pollution rules).
CrowdCulture Events reserves the right to halt production or turn down sound levels if required by on-duty law enforcement or safety officers.
9. Intellectual Property & Photography Rights
All creative blueprints, 3D stage renders, theme concepts, and presentation decks prepared by CrowdCulture Events remain our proprietary intellectual property until full contractual payment is fulfilled.
Unless explicitly restricted under a Non-Disclosure Agreement (NDA) executed prior to the event, CrowdCulture Events reserves the right to capture high-definition photographs and video footage of the stage, decor, and crowd for our portfolio, case studies, and promotional showcases on crowdculture.in and social media.
10. Force Majeure
Neither party shall be held liable for failure or delay in performing event duties if such failure arises from Acts of God, severe cyclones, heavy monsoon flooding, earthquakes, pandemics, government curfews, civic unrest, war, or unexpected municipal lockdowns that make holding the event unlawful or physically impossible. In such events, both parties will cooperate in good faith to reschedule the event.
11. Limitation of Liability
To the maximum extent permitted by applicable Indian law, the total cumulative liability of CrowdCulture Events, its founder Niraj Agarwal, employees, and crew for any claims arising out of an event shall be limited exclusively to the direct service fees actually paid by the client to CrowdCulture Events under the specific contract. We shall not be liable for indirect, incidental, or consequential losses, including lost revenue or brand goodwill.
12. Governing Law & Dispute Resolution
These Terms of Service and any contractual disputes shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute, arbitration, or proceeding shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.
